Welcome to Plantman (“Plantman”, “we”, “us”, or “our”), operated by SUNNRISE GROVE PRIVATE LIMITED. These Terms and Conditions (“Terms”) govern your access to and use of the website www.plantman.co.in, any associated mobile application, and all services offered by us, including the purchase of live plants, pots, and gardening products.

By accessing, browsing, or using the Platform, or by placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must immediately cease all use of the Platform.

These Terms constitute a legally binding electronic contract between you and Plantman, formed in accordance with the Information Technology Act, 2000, and the Indian Contract Act, 1872.

1. Definitions

  • “Platform” means the website www.plantman.co.in, mobile application, and all related services.
  • “User” / “You” / “Customer” means any individual or entity accessing or using the Platform.
  • “Product(s)” means live plants, seeds, gardening tools, pots, fertilizers, and any other items offered for sale.
  • “Order” means any purchase request placed by you through the Platform.
  • “Shiprocket” means our designated shipping and logistics partner.

2. Eligibility

You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into binding contracts under Indian law. If you are using the Platform on behalf of a business entity, you have the authority to bind that entity to these Terms.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

3. User Account

To place orders, you may need to create an account. You agree to provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

4. Products and Information

All Products displayed on the Platform are subject to availability. Due to the live nature of plants, actual size, color, and appearance may vary from the images shown. We make reasonable efforts to display accurate information, but minor natural variations are normal and do not entitle you to a refund or replacement.

Prices are subject to change without prior notice. All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.

5. Ordering and Acceptance

Placing an Order constitutes an offer to purchase. We reserve the right to accept or reject any Order at our discretion, including cases where Products are out of stock, payment fails, or we suspect fraudulent activity.

An Order is accepted only when we send you a dispatch confirmation or ship the Products. Confirmation of receipt does not mean acceptance.

6. Payment Terms

Payments must be made through the secure payment gateways available on the Platform. You authorize us to charge the selected payment method for the Order amount, including shipping charges and applicable taxes.

In case of any chargeback or reversal initiated without valid reason, we reserve the right to block your account and recover all costs and damages. Such actions may also attract liability under relevant provisions of the Bharatiya Nyaya Sanhita (BNS), 2023.

7. Shipping and Delivery

We partner with Shiprocket as our primary delivery partner to ensure safe and timely delivery of your plants across India.

We use specialized packaging to protect live plants during transit. However, delivery success depends on weather conditions, courier handling, and your availability at the delivery address.

Approximate Delivery Timelines:

  • Metro cities: 3–5 business days
  • Tier-2 cities: 5–7 business days
  • Remote and rural areas: 7–10 business days

Shipping charges are calculated based on weight, destination, and courier availability and are shown at checkout. Free shipping may be available on selected orders.

Once shipped, you will receive a tracking link via email and SMS. You must monitor the tracking status and ensure someone is available to receive the consignment. Failed delivery attempts due to incorrect address or unavailability may result in Return to Origin (RTO). Additional shipping charges for re-delivery shall be borne by you.

We are not liable for any damage to plants caused after delivery or due to improper care by the customer.

8. Returns, Refunds, and Cancellations

Due to the perishable and live nature of plants, returns are accepted only in limited cases:

  • If the plant arrives dead or severely damaged (with clear photographic evidence submitted within 48 hours of delivery)
  • If the Product received is materially different from what was ordered due to our error

Returns are not accepted for change of mind, minor aesthetic variations, or damage after delivery.

To request a return:

  1. Contact us within 48 hours of delivery with Order ID and supporting photos.
  2. We will review the claim. If approved, we may offer replacement or refund at our discretion.
  3. Approved refunds will be processed to the original payment method within 7–10 business days.

Cancellations are allowed only before dispatch. Once dispatched, cancellation is not possible.

We comply with the Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020 regarding refunds and grievance redressal.

9. User Conduct and Prohibited Activities

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any law, including the Bharatiya Nyaya Sanhita (BNS), 2023
  • Engage in fraudulent activities, including cheating or dishonest inducement (Section 318 of BNS 2023)
  • Provide false or misleading information
  • Attempt to gain unauthorized access to the Platform
  • Resell Products purchased from Plantman without prior written consent

Any violation may result in immediate account termination, legal action, and reporting to authorities.

10. Intellectual Property

All content on the Platform, including text, images, logos, and product descriptions, is the exclusive property of Plantman or its licensors and is protected by copyright and trademark laws. You are granted a limited, non-exclusive license to use the Platform for personal purposes only. Any unauthorized copying or commercial use is strictly prohibited.

11. Limitation of Liability

To the maximum extent permitted by law, Plantman shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform or purchase of Products.

Our total liability shall not exceed the amount paid by you for the specific Order.

We are not liable for:

  • Damage to plants after delivery
  • Delays or issues caused by Shiprocket or third-party couriers
  • Losses due to force majeure events (natural disasters, extreme weather, strikes, government restrictions, etc.)
  • Any issues arising from improper planting or care by the customer

12. Indemnification

You agree to indemnify and hold harmless Plantman, its directors, officers, employees, and Shiprocket from any claims, losses, liabilities, costs, and expenses arising from your breach of these Terms, violation of any law, or misuse of the Platform.

13. Privacy

Your privacy is important to us. Our Privacy Policy, available on the Platform, explains how we collect and process your personal data. By using the Platform, you consent to the practices described in the Privacy Policy.

14. Grievance Redressal

We have appointed a Grievance Officer to address your complaints:

We aim to acknowledge complaints within 48 hours and resolve them within 30 days, in line with applicable laws.

15. Force Majeure

We shall not be liable for any delay or failure to perform obligations due to events beyond our reasonable control, including natural disasters, pandemics, strikes, or disruptions in shipping by Shiprocket.

16. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kanpur, Uttar Pradesh.

Before initiating legal proceedings, parties agree to attempt amicable resolution. Unresolved disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on the Platform with the revised “Last Updated” date. Your continued use after such changes constitutes acceptance of the new Terms.

18. Entire Agreement

These Terms, along with the Privacy Policy and Shipping & Delivery Policy, constitute the entire agreement between you and Plantman.

19. Compliance with BNS 2023

Plantman strictly prohibits any fraudulent activity on the Platform. Any act involving deception or dishonest inducement may attract criminal liability under Section 318 of the Bharatiya Nyaya Sanhita, 2023 (cheating). We cooperate fully with law enforcement authorities in such cases.
